These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "You," or "Your") and WyrdWeaver ("We," "Us," "Our," or "WyrdWeaver") regarding your use of the WyrdWeaver platform and services. By accessing or using WyrdWeaver, you acknowledge that you have read, understood, and agree to be bound by these Terms.
AI-POWERED TOOL: WyrdWeaver is an AI-powered tool for generative storytelling. You are solely responsible for ensuring that your use of AI-generated content complies with applicable laws, including copyright and intellectual property laws.
WyrdWeaver is an artificial intelligence ("AI") platform designed to assist with tabletop role-playing game ("TTRPG") content generation, including narrative text, non-player character ("NPC") descriptions, worldbuilding elements, and adventure modules ("Output").
Bring Your Own Model (BYOM)
WyrdWeaver allows users to connect third-party AI models via OpenRouter or similar API aggregation services ("Third-Party Models"). We do not own, operate, or control these Third-Party Models. Your use of Third-Party Models is governed by the terms of service of OpenRouter and the respective model providers.
Entity Information
WyrdWeaver is operated by an individual sole proprietor.
Service Availability
Free messages use third-party AI models and are subject to provider availability. WyrdWeaver reserves the right to modify, limit, or discontinue free message access at any time without prior notice. Premium credits and paid subscriptions provide priority access.

Eligibility and Accounts

You must be at least 18 years old to use WyrdWeaver and to agree to the indemnification obligations in Section 8.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

AI-Generated Content and Disclaimers
Nature of AI Content
You acknowledge that WyrdWeaver uses machine learning algorithms to generate content. AI-generated content may be unpredictable, inaccurate, or similar to existing copyrighted works.
No Warranty for Output
ALL OUTPUT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WYRDWEAVER DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI Transparency and Labeling
EU AI Act Compliance: Under the European Union Artificial Intelligence Act (Regulation (EU) 2024/1689), effective August 2, 2026, all AI-generated content must be clearly labeled as artificially generated.
California SB 942 Compliance: If you distribute synthetic content in California, you must disclose its artificial origin in a clear and conspicuous manner.

Intellectual Property Rights
Your Inputs
You retain ownership of any text, prompts, settings, or materials you submit to WyrdWeaver ("Inputs"). By submitting Inputs, you grant WyrdWeaver a limited, non-exclusive license to use, process, and display such Inputs solely to provide the Service.
AI-Generated Output
No Ownership Claim: WyrdWeaver does not claim ownership of Output generated for you. However:
- Uncopyrightable Material: You acknowledge that purely AI-generated content may not be eligible for copyright protection in your jurisdiction.
- Similar Content: Output may be similar or identical to content generated for other users or existing in the training data.

Third-Party Models and OpenRouter
Third-Party Model Disclaimer
WyrdWeaver acts as a platform allowing you to access Third-Party Models via OpenRouter or similar services. We are not responsible for Third-Party Models. We do not own, control, train, or operate Third-Party Models.
Your Assumption of Risk
You bear sole responsibility for selecting, configuring, and using Third-Party Models. You assume all risks associated with your chosen model's propensity to generate copyrighted content, harmful material, or biased information.
You may not use WyrdWeaver to:
🚫 Generate content that infringes third-party intellectual property rights
🚫 Create sexually explicit content involving minors (strictly prohibited)
🚫 Create content for harassment, doxxing, or threats
🚫 Develop malware or harmful code
🚫 Violate any applicable law or regulation

DMCA and Copyright Policy
WyrdWeaver respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

THIS IS A CRITICAL PROVISION. PLEASE READ CAREFULLY.
You agree to indemnify, defend, and hold harmless WyrdWeaver, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising out of or relating to your use of the Service, including claims related to AI-generated content, third-party models, and intellectual property infringement.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

No Indirect Damages
WyrdWeaver shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Cap on Liability
WyrdWeaver's total liability shall not exceed the greater of the amount you paid in the preceding 12 months or $100.
Any dispute shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA). You agree that proceedings will be conducted only on an individual basis and not as a class action.
